IMPORTANT: SECTION XIII CONTAINS A MANDATORY ARBITRATION CLAUSE AND CLASS ACTION WAIVER THAT AFFECTS YOUR LEGAL RIGHTS.
I. Acceptance of Terms
By accessing or using the MedSpa Recruiting platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and MedSpa Recruiting, LLC ("Company," "we," "us," or "our").
II. Description of Service
MedSpa Recruiting provides a technology platform that connects medical aesthetics professionals ("Candidates") with medical spa and aesthetic clinic employers ("Employers"). The Platform includes:
- Candidate profile creation and management
- Employer job posting and management
- AI-powered candidate-employer matching
- Messaging between matched parties
- Salary benchmarking data
- Career resources and blog content
We are a recruiting technology platform, not an employment agency or staffing firm. We do not employ candidates or guarantee employment.
III. User Eligibility and Accounts
You must be at least 18 years old to use the Platform. By creating an account, you represent that:
- You are at least 18 years of age
- You have the legal capacity to enter into these Terms
- All information you provide is accurate and current
- You will maintain the security of your account credentials
You are responsible for all activity that occurs under your account.
IV. User Responsibilities
Candidates
- Provide accurate and current professional information
- Maintain valid professional licenses and certifications
- Respond to employer inquiries in good faith
- Not misrepresent qualifications or experience
Employers
- Post only legitimate job opportunities
- Conduct hiring in compliance with applicable employment laws
- Not discriminate based on protected characteristics
- Maintain confidentiality of candidate information
- Pay agreed-upon compensation to hired candidates
V. Platform Rules and Prohibited Conduct
You agree not to:
- Post false, misleading, or fraudulent content
- Collect or harvest user data without consent
- Circumvent the Platform to avoid fees
- Engage in discriminatory hiring practices
- Upload malware or harmful code
- Violate any applicable laws or regulations
- Interfere with the Platform's operation
- Create multiple accounts to circumvent restrictions
- Use the Platform for any purpose other than legitimate recruiting or job searching
VI. Fees and Payment
Employers pay a one-time lifetime access fee of $997. This fee grants:
- Unlimited job postings
- Access to the candidate matching system
- All current and future platform features
All payments are processed by Stripe. The fee is non-refundable except as provided in our 30-day money-back guarantee. You may request a refund within 30 days of purchase if you have not found a candidate worth interviewing by contacting [email protected].
VII. Disclaimers and No Warranties
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Platform will be uninterrupted or error-free
- Matches will result in successful hires
- Candidate information is accurate or verified
- The Platform will meet your specific requirements
VIII. Algorithmic Matching and Bias Disclaimer
Our Platform uses automated matching algorithms. We make reasonable efforts to ensure these algorithms do not produce discriminatory results. However, we cannot guarantee that algorithmic matching is entirely free of bias. If you believe you have been subject to discriminatory matching, please contact us at [email protected].

IX. Intellectual Property
The Platform, including its design, code, content, and features, is owned by MedSpa Recruiting and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose.
You retain ownership of content you submit (resumes, job postings). By submitting content, you grant us a limited license to use that content to provide our services.
X. Privacy and Communications
Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to receive transactional communications necessary for account security and service delivery.
XI. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA.
XII. Indemnification
You agree to indemnify and hold harmless MedSpa Recruiting and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.
XIII. Dispute Resolution and Arbitration
Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Class Action Waiver: You waive any right to bring or participate in a class action lawsuit or class-wide arbitration.
Small Claims Exception: Either party may bring individual claims in small claims court for disputes within that court's jurisdiction.
XIV. Governing Law and Venue
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. For disputes not subject to arbitration, you consent to the exclusive jurisdiction of courts in Cheyenne, Wyoming.
XV. Changes to Terms
We may update these Terms from time to time. We will provide 30 days' notice of material changes via email. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
XVI. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
XVII. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and MedSpa Recruiting regarding your use of the Platform.
